Swaper mobile application ("Swaper" or the "App") is owned and operated by independent developer Alexey Rybkin. This privacy policy outlines data handling practices for users of the Swaper mobile app. By using the Service, you agree to the collection and use of information in accordance with this policy.
We may update our Privacy Policy from time to time as necessary. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
The categories of personal information we collect depend on how you interact with us, our Services and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services.
We may collect the following personal information that you provide to us.
(a) Photos. We may collect the photos that you upload from your device while using our App. Please note, you will not be able to upload content from your camera roll unless we can access your device's camera.
(b) Generated Content. We may also collect and store the content you generate within the App, including your avatars, subject to the terms of Section 6 ("Retention Of Personal Information").
(c) Face Data. We may collect photos containing your facial geometry for core app functionality. We do not share face data with any third parties. All face data is securelly stored on private cloud storage. You may opt out of our use of this data at any time by using the option in "Menu - Manage My Account - Delete My Account - Delete All Data" in the App or by contacting us at the contact information provided below in Section 8 ("Contact Us").
(d) Purchases. Any payments made via our Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services.
(e) Your Communications with Us. We may collect personal information, such as email address and Account ID when you request information about our Services, request customer or technical support, or otherwise communicate with us.
(f) Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include personal information.
We may collect personal information automatically when you use our Services:
(h) Automatic Data Collection. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), Internet service provider, and metadata about the content you provide which can provide details such as the location of where a picture or video was taken. We may also automatically collect information regarding your use of our Services, such as pages that you visit before, during and after using our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, your history of using the app history, and other information about how you use our Services. In addition, we may automatically collect information that other people provide about you when they use our Services, including information about you when they tag you.
(i) Analytics. We utilize Google Analytics to help analyze usage traffic and metrics to improve the app. It's important to note that the analytics data we handle is general and anonymized. This means that the information is processed in a way that prevents any user from being re-identified. We are committed to ensuring the confidentiality and privacy of our users in all our data analysis practices.
We use your information for a variety of business purposes, including to provide our Services, for administrative purposes, and for advertising our products and services as described below.
We use your information to fulfill our contract with you and provide you with our Services, such as:
(a) Providing our face swap Service;
(b) Managing your information, payment plans and account;

(d) Answering requests for customer or technical support;

(f) Processing your financial information and other payment methods for Services purchased.

These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising.”
We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others' rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.
We take steps to ensure that your information is treated securely and in accordance with this Privacy Notice. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.
By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on our Services, by mail or by sending an email to you.
We may store the personal information we collect as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
(a) Face Data. We collect only the last provided to us facial geometry for as long as you registered in the app. This retention period is designed to keep the necessary functionality of our Services for you. Your old face data will be imediatley deleted and replaced with the new in case you upload and save a new image as your user picture.
(b) Content Uploaded Using Services. Any content that you upload using our Services for the purpose of custom face swaps is stored only short-term during the proccesing period.
(c) Generated Content. Content that is generated through the use of our Services is retained for 30 days. This includes any output produced by the Services based on your input.
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.
